NOTICE IS HEREBY GIVEN that, pursuant to the provisions of Section 10-2-419, Utah Code Annotated (1953, as amended), on April 5, 2017, the City Council of LaVerkin City, Utah adopted a resolution (the “Resolution”), which Resolution declared LaVerkin City’s intent to adjust its common boundary with the Toquerville City (“Toquerville”), scheduled a public hearing regarding the boundary adjustment, and authorized publication of said notice. A copy of the Resolution is on file with the City Recorder at the City Offices, located at 435 North Main Street, LaVerkin, Utah 84745, and may be examined during regular business hours [8:00-5:00, M-Th, and 8:00-3:00 F].


THE TIME AND PLACE of the public hearing will be June 7, 2017 [which is at least sixty (60) days following the date said Resolution was adopted], beginning no earlier than 6:00 p.m., in the LaVerkin City Council Chambers, located at 111 South Main Street, LaVerkin, Utah 84745. All members of the public are welcome to attend and participate in the public hearing. Written comments may be submitted at any time at or before the public hearing. Written comments shall be submitted to the LaVerkin City Recorder, at 435 North Main Street, LaVerkin, Utah 84745.


            THE AREA PROPOSED TO BE ADJUSTED is generally described as:


Commencing at the Southwest Corner of the Northeast Quarter of the Southeast Quarter (NE ¼ SE ¼) of Section 14, Township 41 South, Range 13 West, Salt Lake Base and Meridian; Thence North 00°05’50” East, along the 1/16 ? ?  Section Line a distance of 120.30 feet, to the Point of Beginning; Thence North 00°05’50” East, along said 1/16 ? ?  line, a distance of 250.36 feet; Thence North 90°00’00” East, a distance of 17.78 feet; Thence South 22°15’55” East, a distance of 216.50 feet; Thence South 63°29’39” West, a distance of 112.01 feet to the Point of Beginning.                                     [Containing 14,319 square feet or 0.33 acres, more or less.]


NOTICE IS FURTHER GIVEN that the LaVerkin City Council will adjust LaVerkin City’s common boundary with Toquerville unless, at or before the scheduled public hearing, written protests to the boundary adjustment are filed by the owners of private real property that: (1) is located within the area of property proposed for adjustment; (2) covers at least twenty-five percent (25%) of the total private land area within the area proposed for adjustment; and (3) is equal in value to at least fifteen percent (15%) of the value of all private real property within the area proposed for adjustment. Protests may be filed with the LaVerkin City Recorder, at 435 North Main Street, LaVerkin, Utah 84745.
