LaVerkin City Council Meeting Minutes

Wednesday, January 20, 2010 6:00 p.m.

Present: Mayor Karl Wilson; Councilmembers Ray Justice, Phil Jensen, Hugh Howard, Scott Stratton; Staff: Kyle Gubler, Attorney Kevin Bennett, Chief Lloyd Watkins, June Jeffery, Derek Imlay, Troylinn Benson, Rory Johnson; Public: None

Councilmember Beecher arrived late.

Meeting Called to Order-6:00 p.m. by Mayor Karl Wilson - Invocation and Pledge of Allegiance by Hugh Howard

Appointments: Mayor Wilson recommended appointment of Scott Stratton as Council Representative to the Fire District. Motion by Councilmember Justice to approve the appointment, second by Councilmember Jensen. Motion carried unanimously.

Consent Agenda: (Items on the consent agenda may not require discussion. These items will be a single motion unless removed at the request of the Mayor or City Council.)

Motion by Councilmember Jensen to approve the consent agenda with invoices and checks of $160,450.57, second by Councilmember Howard. Roll Call Vote: Stratton-yes, Jensen-yes, Justice-yes, Howard-yes. Motion carried unanimously.

Committee Reports:

Planning Commission: Scott Stratton attended the meeting for Ray Justice. The commission discussed adjusting and adopting the Master Road Plan to shift the road to the north, not affecting the southern property owners; and to address the width issue through the mapping. They also read part of a proposed hillside ordinance as an introduction to an amendment to the ordinance.

Water Board: No meeting.

Sewer Board: No representative.

Fire Department: Chief Kuhlmann asked to be excused.

Citizen Comment & Request for Future Agenda Items: No Public Comment

Public Hearings: Budget Amendment - FY 2009-2010: Mayor Wilson explained that this amendment was a clean up from the amendment that was done at the last regular council meeting. $10,200 was budgeted into the funds, but was not posted in the capital projects under Non-Operating Expense. This amendment completes that transfer.

Mayor Wilson opened the public hearing.

There were no public comments.

Unfinished Business:

Budget Amendment FY 2009-2010 - Resolution R-2010-05: The resolution corrects the line item as stated above.

Motion by Councilmember Beecher to approve R-2010-05 amending the FY 2009-2010 Budget, second by Councilmember Howard. Roll Call Vote: Stratton-yes, Beecher-yes, Jensen-yes, Justice-yes, Howard-yes. Motion carried unanimously.

Zion View Park bid discussion: Kyle Gubler showed samples of rubberized chips from Hurricane Park. Darren Barney, parks director for Hurricane City, is satisfied with the rubber chips. They don't blow away, but stay in place. They are a hassle with the mowers when they get in the lawn. He likes the big chunks better than the pellets. His supplier contacted Gubler in an email just prior to the meeting, with prices for everything else but rubber chips. Gubler has visited with several parks and school grounds directors.

Aziz from Kanab is not in favor of the chunks. They received rubber chunks from a company called "Stampin' Up" in Kanab. The chips kill the lawn and are hard to remove from the grass.

Doug Slack is the janitor at Three Falls Elementary. They have pellets, which are a nightmare to the lawn. They also track into the school and are a problem with vacuums.

Taft Egan from Great Western Parks and Playgrounds sells the rubber chunks not the pellets, and doesn't recommend it.

Mark Goble from St. George City uses no rubber chips or pellets. They have wood chips. They would like to use rubber tiles but cost is a problem.

Darren Barney from Hurricane recommended the bigger rubber chips. They have a sidewalk around the play area that can be swept fairly easily.

The company that donated to Kanab Park will sell their chips to the city for about the cost of wood chips. It will take about 10,000 lbs. to cover an area of 100 sq. ft. 4 inches deep at 15 cents a lb. The city would need to prepare the surface, and pick up the rubber. Discussion that this rubber is probably discards from a stamp company. Kevin Bennett has been there with his family. It was "very cushy". Discussion that the pieces will be red and since they are bigger will be more easily seen in the grass. Gubler stated that John Postert, the LaVerkin parks director, would prefer rubber tiles, but the cost would be about $13,000 plus maintenance. Bennett stated that his family went to "Jumping Jacks" in St. George where tiles are installed. They were inside and not affected by weather and seemed to hold up well. There were tiles that had some corners pulled up and were a tripping hazard. They were also quite hard.

Phil Jensen wondered about the number of kids that actually use the park in Zion View. Discussion that bigger kids probably use the Wanlass Park. Wood chips there aren't as big a problem because there are no close neighbors for the chips to blow to. Insurance doesn't allow wood chips to mix with rubber.

Cost of the rubber chips would need to include concrete slurry as prep work.

Scott Stratton believed that the Kanab Park should be looked at. Doug Beecher was skeptical that the rubber would stay in place. Gubler said that Darren Barney in Hurricane said the rubber chunks don't blow. Beecher suggested that when looking at parks, one should look beyond the play areas to see what happens to the rubber. When Phil Jensen looked at the rubber pieces, there was a pretty good wind. They didn't blow. Gubler remarked that kids do move the chips around. The biggest complaint from people he talked to was the maintenance.

Hugh Howard wondered about "pour in place" coating. It is about $15,000. Howard thought that if the city decided on tiles, they should probably look at the pour in place instead. Karl Wilson stated that there is no money. He would like to install the rubber as in Kanab for a couple of years and see how it goes. The cost will be the same as wood chips and something has to be done to meet insurance requirements. Rubber won't compact like wood chips. Stratton and Wilson will look at the Kanab Park.

There was a question whether 4" is enough to meet the insurance requirement. Discussion that the city will need to have a flat bed to pick up the 10,000 lbs. of rubber if that decision is made.

Motion by Councilmember Jensen to give Mayor Wilson, Councilmember Stratton, and City Administration direction to check out the Kanab Park rubber chips. If the review is positive, permission to move ahead with the purchase, second by Councilmember Justice.  Discussion on the motion: Beecher would like to make sure that the price is around $1500. Wilson stated that if the need is for 11,000 lbs. the price would be about $1,650. Roll Call Vote: Howard-yes, Justice-yes, Jensen-yes, Beecher-yes, Stratton-yes. Motion carried unanimously.

Staff, Mayor, & Council Reports:

City Administrator: Kyle Gubler stated in direction to Hugh Howard regarding the recreation committee, that directors for the Easter Egg Hunt, the 4th of July, and Winterfest will need to be found. Martha Gubler, who did the egg hunt last year has said she wouldn't do it again but would help. Heather Beatty helped last year. Marva Stevens headed up the 4th of July celebration the last two years. Sandi Gubler was over the Winterfest in 2009. Both Stevens and Gubler have said that they are not interested in running those events this year.

Public Safety: 10 days ago the department ran a raid with search warrant on a house where dope was found. Tazed a guy in the house. Both the officer and the guy were sent to the hospital and released. The house is believed to have been a "safe house". With the raid, it is hoped that the word reverberates through the drug community that LaVerkin won't put up with the activity. There were people jailed from the raid. The landlord of the property was also notified. Mayor Wilson supported the department saying that the more the department works in this direction, the better the city's reputation becomes.

Director of Operations: No report.

Treasurer: Troylinn Benson introduced Rory Johnson as the new front desk/cleaning hire. He is doing a good job. He had his first taste of shut-offs today. There were 198 letters sent, 103 door hangers, with 6 houses still off.

Beecher wondered about the monthly financial reports. The front desk has been busy with shut-offs, the reports didn't get printed this meeting. Will be in at the next meeting.

Mayor & Council as follows:

Mayor Wilson: Working toward budget work meetings for the FY 2010-2011 budget. Tentative budget before May. Want a couple of work meetings before that time - probably one with the 2nd meeting in February.

Jensen: No report

Justice: ZC3 meeting was cancelled, Confluence Park meeting cancelled. Attended the Shooting Sports Park meeting for Stratton because of time conflict. NRA visit the park. The organization facilitated grant money. Passed a waiver for any active duty person for the future.

Beecher: No report.

Stratton: No report.

Howard: No report.

Adjourn: Motion by Councilmember Justice, second by Councilmember Beecher. Motion carried unanimously. 6:34 p.m.
